Outside number 39 stag lane, corner house before stag close

Sent to Brent Council less than a minute later. FixMyStreet ref: 9273143.

The pavement at the above location is in a hazardous and defective condition. Several paving slabs are uneven, cracked, and misaligned, with raised edges creating an irregular walking surface. There is also a poorly maintained transition between paving slabs and a worn section of tarmac, which is eroded and uneven.

This condition presents a clear trip hazard to pedestrians and falls below the standard of maintenance expected under Section 41 of the Highways Act 1980, which places a duty on the council to maintain highways in a safe condition.

As a direct result of this defect, I tripped and fell while walking along the pavement. During the fall, I sustained a laceration underneath my right eyebrow. I required immediate medical attention and attended hospital straight after the incident.

I have obtained medical documentation from the hospital confirming the injury and treatment received, which I will provide upon request, as there is no facility to attach documents with this submission.

The injury caused pain, distress, and inconvenience, and may result in further impact. I am also concerned that this defect poses an ongoing risk to other members of the public.

Given the visible and significant nature of the defect, it is reasonable to expect that it should have been identified and repaired during routine inspections. I therefore believe the council has failed in its duty to adequately inspect and maintain the pavement.

I request that:

Please treat this correspondence as a formal letter of claim. I will be seeking compensation for my injuries and any associated losses, including medical treatment and any other related expenses.

I expect this matter to be treated with urgency. Please confirm what action will be taken to repair the pavement and prevent further incidents. I also request that this be formally recorded as a claim and that you provide details of your insurance process.

  • This problem has been received by our Highways Team. We plan to inspect within 20 days and provide an update.

  • This problem has now been inspected. Limited Council resources mean that it is not possible to repair each and every defect, and we have to prioritise cases that pose the most risk to the public so a further assessment by officers is required. We hope to make a decision on this repair within the next 14 days and provide a further update. If this defect is selected for repair, our contractor will have a further 28 days to carry out the work
